Protecting your privacy is very important to us. In order to inform you about the collection, processing and use of your personal data on our websites, applications and social media profiles, we have prepared the following information for you.
The collection, processing and use of your personal data is carried out in accordance with the strict requirements of European data protection law under the principles of data minimization, transparency and data security. Your data will only be processed and used by us and our trade and service partners to the extent that this is necessary and desired by you for the execution of the contract concluded with you or the approved service and the maintenance of the resulting customer relationship.


1.     Personal data and responsibility

1.1         Personal data is all data that is personally referable to you, so for example, name, address, e-mail addresses, user behaviour.

1.3         In the event that we wish to use service providers commissioned by us for individual functions of our offers or use your data for advertising purposes, we will inform you in detail about the respective processes below. We also specify the defined criteria for the storage period.


2.     Types of data and purpose of data processing

2.1         We process usage data (access times, websites visited etc.), inventory data (name, address etc.), contact data (telephone number, e-mail, fax etc.), payment data (bank data, account data, payment history etc.), contract data (subject of contract, term of contract etc.), content data (text input, videos, photos etc.), communication data (IP address etc.).

2.2         BLUE HILLS (including our employees), our cooperation partners (e.g. other real estate agents) and service providers commissioned by us (contract processors) process your personal data on the basis of the successful fulfilment and execution of the contract. Without these we cannot conclude and process the contract. We also use your personal data to send you information about the products and services we offer in the areas of real estate, real estate financing and lifestyle.

2.3     Your personal data will be processed for the following purposes:
Processing of contracts
Performance of contractual obligations
User requests for the purpose of website registration
Provision of the website services (e.g. registration, account access)
Technical measures for statistical evaluation
To protect against fraud and abuse
Compliance with legal retention requirements and compliance with legal requirements.


3.     Legal basis for the processing of personal data

The processing of personal data takes place on the basis of the following legal principles:

3.1 If we have obtained your consent for the processing of personal data, Art. 6 Para. 1 clause 1 lit. a) GDPR.

3.2 If the processing is necessary for the fulfilment of a contract or for the execution of pre-contractual measures, which take place on your request, then Art. 6 Para. 1 clause 1 lit. b) GDPR.

3.3 If the processing is necessary to fulfil a legal obligation to which we are subject (e.g. legal storage obligations), Art. 6 Para. 1 clause 1 lit. c) GDPR.

3.4 The processing is necessary to protect the vital interests of the data subject or another natural person; 1 clause 1 lit. d) GDPR.

3.5 If the processing is necessary to protect our or the legitimate interests of a third party and your interests or fundamental rights and freedoms do not prevail in this regard, Art. 6 Para. 1 S. 1 lit. f) GDPR


4.     Data collection when contacting via contact form and e-mail

4.1 When contacting us via contact form or e-mail, your details will be processed for the purpose of processing the contact request.

4.2 The legal basis for processing the data, if the user's consent to this has been obtained, is Art. 6 para. 1 clause 1 lit. a) GDPR. The legal basis for processing the data transferred in the course of sending an email is Art. 6 para. 1 clause 1 of point f) GDPR. BLUE HILLS has a legitimate interest in the processing and storage of the data in order to be able to answer user queries, to preserve evidence for reasons of liability and, where applicable, to be able to comply with its statutory storage obligations for business letters. If the contact is aimed at the conclusion of a contract, then an additional legal basis for the processing is Art. 6 Para. 1 clause 1 of point b) GDPR.

4.3 We may store your details and contact request in our Customer Relationship Management System ("CRM System") or a similar system.

4.4 All data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. For the personal data from the contact form input screen and the data that was sent by e-mail, this is the case when the respective conversation with you has been completed. The conversation is terminated when the circumstances indicate that the matter in question has been finally resolved. We store requests from users who have an account or contract with us for a period of two years after termination of the contract. In the case of statutory archiving obligations, deletion shall take place after their expiry.


5.     Data collection when contacting by telephone

5.1 When contacting us by telephone, your telephone number will be processed to process the contact request and its processing and temporarily stored or displayed in the RAM / cache of the telephone device / display. The storage takes place for liability and security reasons, in order to be able to lead the proof of the call as well as for economic reasons, in order to make a recall possible. In case of unauthorized advertising calls we block the phone numbers.

5.2 The legal basis for processing is Art. 6 para. 1 clause 1 lit. f) GDPR. If the e-mail contact is aimed at the conclusion of a contract, then an additional legal basis for the processing is Art. 6 para. 1 lit. b) GDPR.

5.3 The device cache stores the calls and overwrites or successively deletes old data; if the device is disposed, all data is deleted and the memory may be destroyed. Locked telephone numbers are checked annually for the necessity of being locked.

5.4 You can prevent the phone number from being displayed by calling with the phone number suppressed.


6.     Data collection when visiting the BLUE HILLS website

6.1    In the case of purely informational use of our website (without registration or transmission of information), we only collect personal data transmitted by your browser to our server. The following data is required for technical reasons to be able to display our website to you and to guarantee stability and security (legal basis is Art. 6 para. 1 page 1 lit. f of the GDPR):

6.2    In addition to the above data, cookies are stored on your computer when you use our website (see also Section 12). 

7.     Deletion of data and storage duration

Unless otherwise expressly stated in this data protection declaration, your personal data will be deleted or blocked as soon as the purpose for which it was stored no longer applies, unless its further storage is necessary for the purposes of proof or statutory storage obligations stand in the way of this. This includes, for example, obligations under commercial law to retain business letters in accordance with § 257 para. 1 HGB (6 years) as well as tax retention obligations according to § 147 para. 1 AO of receipts (10 years). If the prescribed retention period expires, your data will be blocked or deleted, unless storage is still necessary for the conclusion of a contract or for the fulfilment of the contract.


8.     The existence of automated decision-making

We do not use automatic decision-making.


9.     Data access

Your data will be processed in accordance with Art. 5 ff GDPR. Your data will be processed by the following persons:

9.1     Employees who are authorized to administer the website and provide the associated services (e.g. customer service, IT department, etc.).

9.2     Employees in marketing, finance, administration and accounting.

9.3     External service providers and third party companies (e.g. IT service providers, hosting providers, etc.) to which contract processing activities have been outsourced.

9.4     BLUE HILLS partners who offer real estate as part of the real estate search and to whom the user sends a contact request.


10.     Transfer of personal data to third parties, processors and transfer to third countries

10.1     Without your consent we do not pass on any data to third parties. Should this nevertheless be the case, then the transfer shall take place on the basis of the above-mentioned legal bases, e.g. in the case of the transfer of data to online payment providers for the fulfilment of the contract or due to a court order or due to a legal obligation to transfer the data for the purpose of criminal prosecution, averting danger or enforcing intellectual property rights.

10.2     We use contract processors (external service providers e.g. for web hosting of our websites and databases) to process your data. If data are passed on to processors within the framework of an agreement on order processing, this is always done in accordance with Art. 28 GDPR. We carefully select our contract processors, check them regularly and have been granted the right to issue instructions with regard to the data. In addition, processors must have taken appropriate technical and organisational measures and must have complied with the data protection rules in accordance with GDPR.

10.3     The adoption of the European General Data Protection Regulation (GDPR) has created a common basis for data protection in Europe. Your data will therefore mainly be processed by companies for which GDPR applies. Should the processing take place by services of third parties outside the European Union or the European Economic Area, these third parties must satisfy the special conditions of Art. 44 et seq. of the GDPR. This means that the processing takes place on the basis of special guarantees, such as the official recognition by the EU Commission of a level of data protection equivalent to that of the EU or the observance of officially recognised specific contractual obligations, the so-called "standard contractual clauses". For US companies, submission to the so-called "Privacy Shield", the data protection agreement between the EU and the USA, fulfils these requirements.


11.     Rights of users

11.1     You have the following rights with respect to personal data relating to you:

Right to object 

Insofar as we do not process your personal data on the basis of the weighing of interests pursuant to Art. 6 para 1 point f) GDPR, you can object to the processing at any time. This is the case if processing is not necessary in particular to fulfil a contract with you, which is described by us in the description of the functions. When exercising such objection, we ask you to explain the reasons why we should not process your personal data as we have done. In case of your justified objection, we will examine the situation and either stop or adjust data processing or point out to you our compelling reasons worthy of protection, on the basis of which we will continue processing.

You may of course object to the processing of your personal data for advertising and data analysis purposes at any time. You can exercise your right to withdraw your consent free of charge. You can inform us about your advertising conflict via the following contact information:

Right to revoke permission

As far as the processing on your consent according to Art. 6 para. 1 sentence 1 lit. a), Art. 7 GDPR, you have the right to revoke your consent at any time. The legality of the processing carried out on the basis of the consent until revocation is not affected.

The right to be informed

You have the right to information about your personal data stored by us in accordance with Art. 15 GDPR. In particular, you may obtain information on the purposes of the processing, the category of personal data, the categories of recipients from whom your data have been or will be disclosed, the planned storage period, the origin of your data, unless they have been collected directly from you,

The right to correction or deletion,

Right to data portability

You have a right to data transfer in accordance with Art. 20 GDPR, which means that you can receive the personal data we store about you in a structured, common and machine-readable format or request that it be transferred to another responsible person.

12.     Cookies

12.1    Cookies are small text files that are stored on your hard disk in association with the browser you're using and by which the body which sets the cookie (in this case, us), transmits certain information. 12.2     Our website uses Transient Cookies and Persistent Cookies.

Transient cookies are automatically deleted when you close the browser. It especially includes session cookies. Session cookies are deleted when you log out or close the browser.

13.    Newsletter

13.1 You can subscribe to our newsletter with your voluntary consent by entering your e-mail address. Only this one is obligatory. The provision of further data is voluntary and serves only the purpose of a personal approach. 

13.2 In addition, we log your IP address used for registration as well as the date and time. The purpose of this storage is to meet legal requirements regarding proof of your registration and to prevent misuse of your e-mail.

13.3 Within the scope of your declaration of consent, the contents (e.g. advertised products/services, offers, advertising and topics) of the newsletter are described in concrete terms.

13.4 When sending the newsletter, we evaluate your user behaviour. The newsletters contain so-called "web beacons" or "tracking pixels" which are called up when the newsletter is opened. For evaluation purposes, we link the above data and web beacons to your e-mail address and an individual ID. Links included in the newsletter also contain this ID. The data will only collect pseudonyms, so the IDs are not linked to your personal data and are not directly linked to you personally. With these data we can determine if and when you opened the newsletter and which links were clicked in the newsletter. This serves the purpose of optimising and statistically evaluating our newsletter.

13.5 We use the above data to create a user profile in order to identify the reading habits and interests of our users and thus individualise the newsletter. If you have also performed other actions on our website, we also link this data to it in order to adapt our newsletter content to your interests.

13.6 Legal basis for the newsletter dispatch, success measurement and the storage of the E-mail is your consent in accordance with. Art. 6 para. 1 sentence 1 lit. a) GDPR in conjunction with § 7 para. 2 No. 3 UWG and for the recording of the consent Art. 6 para. 1 p. 1 lit. f) GDPR, as this serves our legitimate interest of legal provability.

13.7 You can object to tracking at any time by clicking the unsubscribe link at the end of the newsletter. In this case, however, the newsletter reception would also be terminated. If you deactivate the display of images in your e-mail software, tracking is also not possible. However, this may have restrictions regarding the functions of the newsletter and the images contained will not be displayed.

13.8 You can revoke your consent to receive the newsletter at any time. You can exercise your right of withdrawal by clicking the unsubscribe link at the end of the newsletter, sending an e-mail or sending a message to our contact details above. We store your data as long as you have subscribed to the newsletter. After logging out, your data will only be stored anonymously for statistical purposes.


14. Google Adsens


14.1     We have integrated advertisements of the Google service "Adsense" (Google Inc., 1600 Amphitheater Parkway, Mountainview, California 94043, USA) on our website. The advertisements shall be identified by the (i)-notice "Google advertisements" in each advertisement. We have enabled the personalized ads to provide you with more interesting advertising that supports the commercial use of our site, adds value to us, and improves the user experience for you. Through personalized advertising, we can reach users through Adsense based on their interests and demographics (e.g., "sports enthusiasts").
14.2     For these purposes, when you visit our website, Google will receive information that you have visited our website. To do this, Google places a web beacon or cookie on your computer. The full extent of the data processing and the storage period is not known to us. The data is also transferred to the USA and analyzed there. If you are logged in with a Google account, Adsense can assign the data to your account. If you do not wish this, you must log out before visiting our website.
14.3     However, other information may also be used by Google for this purpose:
- the type of websites you visit and the mobile apps installed on your device;
- Cookies in your browser and settings in your Google Account;

14.4     When clicking on an Adsense advertisement, the IP of the user is processed by Google (usage data), whereby the processing is pseudonymised (so-called "advertising ID") by shortening the IP by the last two digits.
14.5     Google does not link identifiers from cookies or similar technologies to special categories of personal data pursuant to Art. 9 GDPR, such as ethnic origin, religion, sexual orientation or health, for personalised advertising.
14.6     It cannot be excluded that the above information may be shared with third parties, government agencies or Google partners. This site also has also enabled third-party Google AdSense ads. The aforementioned data can be transferred to these third parties (named under https://support.google.com/dfp_sb/answer/94149).

16.1     We use the application Google AdWords Remarketing/"Similar Target Groups"". (Google Inc., 1600 Amphitheater Parkway, Mountainview, California 94043, USA), to promote the websites of third parties and other Internet offers by displaying our website. With the remarketing or "similar target groups" function in AdWords, we can reach you there if you have already visited our website and are addressing you with a suitable message via advertisement. With remarketing, we can bring our previous visitors back to our website with a single click. When you visit certain pages of our website, a cookie is stored in your browser which is valid for 30 days. 17.1     We use the remarketing function "Custom Audiences" of Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA or, if you are resident in the EU, Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland on our website. 17.2     When you visit the social network Facebook or other websites that use this remarketing feature, your interest-based ads ("Facebook Ads") may be displayed. We use the remarketing function to optimise and economically operate our website and to show you as much advertising as possible that interests you, thus making our website more user-friendly.
17.3     When you visit our website, your browser connects to Facebook's servers. We do not know exactly which data is transferred to Facebook in the process. However, Facebook receives the information that you have called or clicked on a corresponding advertisement. 17.4     The legal basis for this is our legitimate interest in data processing in accordance with Art. 6 Para. 1 clause 1 of point f) GDPR.

18.     Google Analystics

18.1     We have integrated the website analysis tool "Google Analytics" (Google Inc., 1600 Amphitheater Parkway, Mountainview, California 94043, USA, EU branch: Google Dublin, Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland) on our website.
18.2     When you visit our website, Google places a cookie on your computer in order to analyse your use of our website. The collected data is transferred to the USA and stored there. If personal data is to be transferred to the USA, Google's certification under the Privacy Shield Agreement (https://www.privacyshield.gov/EU-US-Framework) provides a guarantee that European data protection law will be complied with.
18.3     We have activated the IP anonymization "anonymizeIP", whereby the IP addresses are further processed only shortened. As a result, your IP address will be shortened beforehand by Google within the Member States of the European Union or in other states which are party to the Agreement on the European Economic Area. Only in exceptional cases, the entire IP address will be transmitted to a Google server in the USA and truncated there. Google will use this information on behalf of the operator of this website to evaluate your use of the website, to compile reports on website activity, and to provide other services relating to website activity and internet usage for the website operator. In addition, we have activated the cross-device analysis of website visitors, which is carried out via a so-called user ID. The IP address transmitted by your browser as part of Google Analytics is not associated with other data by Google. The use of Google Analytics serves the purpose of analysing, optimising and improving our website.
18.4     The legal basis for this is our legitimate interest in data processing in accordance with Art. 6 para. 1 clause 1 of point f) GDPR.
18.5    The data sent by us and linked with cookies, user IDs or advertising IDs are automatically deleted after several months. All data whose retention period has been reached is automatically deleted.
